MS&B Assists Municipalities with Stormwater Regulatory Compliance

The Environmental Law Group of McManimon, Scotland & Baumann, LLC (MS&B) has been successfully assisting clients in complying with the terms and conditions of Administrative Consent Orders (ACO) issued by the U.S. Environmental Protection Agency (EPA) related to the New Jersey Pollutant Discharge Elimination System Tier A Municipal Stormwater General Permit (MS4 Permit). The EPA and N.J. Department of Environmental Protection (NJDEP) have both recognized that stormwater runoff is the leading cause of water quality problems among New Jersey surface water bodies. Although the NJDEP regulates municipal separate storm sewer systems through its MS4 Permit program, due to common municipal non-compliance, the EPA has initiated a programmatic effort to exercise its right, under the Clean Water Act, to separately enforce violations of MS4 Permit through the issuance of ACOs with specified compliance deadlines and significant, daily, civil penalties for non-compliance. MS&B has helped get clients back into compliance with the MS4 Permit and ACO by negotiating reasonable deadlines and terms and then managing performance, including coordination with different municipal departments and outside engineers.
