Appellate Court Sides with the Borough of Keyport in Cannabis License Challenge
After more than two years of litigation, the Borough of Keyport’s decision to approve Blaze Cannabis for operation in the Commercial Highway District has been fully upheld.
Thanks to Ted Del Guercio and Jessica Silva’s legal guidance, Keyport was able to defend its 2022 resolution of support. From trial court to the appellate division—and with the challenger, KGNJ, opting not to seek review by the state supreme court—the Borough’s position has been affirmed at every level.
And, while this case centered on a single license, the outcome sets a broader precedent. It reinforces the Borough’s authority to make planning and zoning decisions that support local priorities, like supporting small businesses, encouraging investment, and expanding tax revenue.
With a final decision in place, Blaze Cannabis has the go-ahead to proceed with its development plans, bringing new jobs and long-term economic growth to Keyport.
