MS&B Secures Favorable Outcome in AAA Arbitration

McManimon, Scotland & Baumann, LLC is pleased to report a successful outcome in a complex American Arbitration Association (AAA) commercial arbitration matter, where Member Sari B. Placona represented the respondents in a dispute arising among members of a Delaware limited liability company.

The claim, which sought approximately $850,000 in restitution, along with costs and fees, stemmed from allegations that distributions made to MS&B’s client following the sale of company equipment and infrastructure were improper and should be returned. The matter involved significant factual and financial issues, including a 232-page expert report submitted by the claimant.

Following two days of hearings in Miami, Sari presented witness testimony and challenged the claimant’s expert analysis, which the arbitrator ultimately found to be incomplete. In particular, the decision noted that the expert’s conclusions failed to account for the LLC’s full financial picture, including payments made to other members that were not addressed in the report.

The arbitrator determined that the claimant did not meet its burden of proof and ruled in favor of MS&B’s client, denying the claims in full.

This outcome reflects the firm’s strength in handling high-stakes arbitration matters and its ability to effectively address complex financial and evidentiary issues on behalf of clients.
