Partner Eric Tomaszewski Successfully Refutes Landlord Demand for PFAS Remediation for Industrial Tenant
Eric Tomaszewski, MS&B’s Chair of the Environmental Law Department, recently secured the favorable resolution of a landlord’s demand that an industrial tenant conduct an investigation and remediation related to PFAS contamination in groundwater.
Eric helped his client refute the demand, on the grounds that it wasn’t supported by the terms of the lease or the specifics of the tenant’s operations.
He then coordinated with the tenant’s environmental consultant to demonstrate to the New Jersey Department of Environmental Protection that the PFAS contamination in groundwater was attributable to an off-site source—not the tenant’s operations.
